Event Liability Waiver & Participation Agreement
1. Agreement to Participate
By registering for, accessing, or attending any event organized, hosted, or promoted by CIBA Startups ("Event"), you agree to this Event Liability Waiver & Participation Agreement.
CIBA Startups operates under CIBA Business Network.
2. Voluntary Participation
Your participation in the Event is entirely voluntary. Events may be held in-person, virtually, or in a hybrid format. You understand that participation may involve traveling to and from the Event, entering and moving within event venues, interacting with attendees, speakers, sponsors, vendors, volunteers, or other third parties, and being present in crowded or dynamic environments. You acknowledge that you are solely responsible for deciding whether to participate and whether the Event environment is appropriate for you.
3. Assumption of Risk
You understand and accept that participation in the Event involves inherent and other risks, whether known or unknown, foreseeable or unforeseeable. These risks may include, without limitation:
- Personal injury, illness, accident, or medical emergency
- Property damage, theft, or loss
- Risks arising from travel to or from the Event
- Risks arising from movement within event spaces, crowd conditions, or venue conditions
- Risks arising from interactions with other attendees, speakers, sponsors, vendors, volunteers, or third parties
- Risks associated with the use of event facilities, furniture, equipment, technology, food service areas, or third-party services
You voluntarily assume all such risks to the fullest extent permitted by law.
4. Release of Liability
To the fullest extent permitted by law, you release and hold harmless CIBA Startups, its parent organization, affiliates, officers, volunteers, partners, and event hosts from any and all claims, damages, or liabilities arising from or related to:
- Your participation in the Event
- Conditions at or related to the event location
- Actions or behavior of other participants or third parties
This release applies to all claims, including those arising from negligence, except where prohibited by law.
Nothing in this Agreement shall be construed to release liability for gross negligence, willful misconduct, or intentional acts.
This release is binding upon you and your heirs, assigns, and legal representatives. This release applies to the fullest extent permitted by applicable law.
5. Third-Party Venues and Services
Events may take place at third-party venues or involve third-party vendors, sponsors, service providers, speakers, exhibitors, contractors, or other participants. CIBA Startups does not own, manage, or control such third parties and is not responsible for their acts, omissions, services, products, conduct, security measures, or venue conditions.
You understand and agree that CIBA Startups makes no representation or guarantee regarding the safety, suitability, or performance of any third-party venue or service. Any claim, loss, injury, or damage arising from the acts or services of any third party must be brought solely against that third party and not against CIBA Startups.
6. Participant Conduct
You agree to behave in a professional, respectful, and lawful manner. CIBA Startups reserves the right, at its sole discretion, to deny entry to or remove any participant at any time for inappropriate, unsafe, unlawful, or disruptive behavior, without refund or liability.
7. No Guarantees
Events are intended for networking, informational, and community engagement purposes only. CIBA Startups does not guarantee any particular result, outcome, or benefit from attending or participating in any Event, including without limitation:
- business opportunities
- partnerships, collaborations, or introductions
- investments, funding, or financial outcomes
- mentorship, advisory support, or follow-up opportunities
- media exposure, publicity, or promotional visibility
- selection for any program, feature, initiative, or future opportunity
8. Health and Safety Responsibility
You are solely responsible for your own health, safety, and wellbeing before, during, and after the Event. You agree not to attend if you are unwell or believe you may pose a risk to others. You also agree to comply with all applicable venue rules, posted instructions, and reasonable safety-related directions.
CIBA Startups does not provide medical care, supervision, or health insurance for participants and is under no obligation to provide medical assistance, security services, or personal supervision. Any assistance that may be provided does not create any ongoing duty or liability.
8A. Personal Property
You are solely responsible for your personal property and belongings at all times. CIBA Startups is not responsible for any lost, stolen, misplaced, or damaged property, whether occurring at the Event venue, during the Event, or in connection with travel to or from the Event.
8B. Alcohol and Substances
If alcohol is present, served, or consumed at or in connection with the Event, you acknowledge that you remain solely responsible for your own conduct, decisions, and safety. You agree not to participate in a manner that could endanger yourself or others due to impairment. CIBA Startups shall not be liable for any incident, injury, or damage arising out of or related to the consumption of alcohol or other substances, except to the extent prohibited by law.
9. Media and Recording
Events may be photographed or recorded.
By attending, you consent to the capture and use of your image, voice, and likeness in accordance with the CIBA Startups Media Release & Consent Agreement.
10. Indemnification
You agree to indemnify, defend, and hold harmless CIBA Startups and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your participation in the Event
- Your actions or conduct
- Your interactions with other participants
- Any statements, representations, or information you provide or share in connection with the Event
This obligation will survive your participation in the Event.
11. Governing Law
This Agreement is governed by the laws of the State of California.
12. Acceptance
By registering for, accessing, attending, or participating in the Event, including through electronic registration, RSVP, check-in, or attendance, you confirm that you have read, understood, and voluntarily agreed to this Agreement. Where a checkbox, digital confirmation, or similar acceptance mechanism is used, such action constitutes your legally binding acceptance of this Agreement to the fullest extent permitted by law.
13. Severability
If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
13A. Limitation of Liability
To the fullest extent permitted by law, if any portion of the liability limitations in this Agreement is found unenforceable, the total liability of CIBA Startups and its affiliates for any claim arising out of or relating to the Event shall be limited to the amount, if any, paid by you to attend the Event. If no fee was paid, such liability shall be limited to zero dollars ($0), to the fullest extent permitted by law.
14. Force Majeure
CIBA Startups shall not be held liable for any failure or delay in the use, publication, or distribution of content resulting from causes beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, labor disputes, failures of third-party service providers, internet outages, or other events outside our reasonable control.
15. Changes to This Agreement
We may update or modify this Event Liability Waiver & Participation Agreement at any time in our sole discretion. Any changes will become effective upon posting or otherwise making the updated version available. By continuing to register for, attend, or participate in any Event after such updates, you agree to the revised version of this Agreement.
